Release of Liability and Assumption of Risk

Last updated: April 6, 2026

PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS. BY PARTICIPATING IN ANY BECOME A YOGI TRAINING, RETREAT, MASTERCLASS, OR OTHER IN-PERSON PROGRAM, YOU AGREE TO THE FOLLOWING TERMS.

This Release of Liability and Assumption of Risk Agreement ("Release") is entered into between you ("Participant," "you," or "your") and Become A Yogi, including its founder Jonah Kest, its assistant teachers, contractors, employees, agents, and venue partners (collectively, the "Released Parties").

1. Voluntary Participation

You acknowledge that your participation in any Become A Yogi program is entirely voluntary. You are not required to participate, and you may withdraw at any time. You have chosen to participate of your own free will, after considering the nature of the program and your own physical and mental condition.

2. Acknowledgment of Inherent Risks

You understand that yoga is a physical practice that involves the use of the body in ways that may carry inherent risks. These risks include, but are not limited to:

  • Physical injury from postures, transitions, hands-on adjustments, falls, strains, sprains, fractures, and dislocations.
  • Cardiovascular events including elevated heart rate, blood pressure changes, dizziness, fainting, and in rare cases, more serious cardiac events.
  • Respiratory effects from breathwork (pranayama) practices, including hyperventilation, lightheadedness, and altered states of consciousness.
  • Heat-related illness including dehydration, heat exhaustion, and heat stroke, particularly during practice in warm climates.
  • Emotional and psychological responses including the surfacing of difficult emotions, memories, anxiety, depression, or other psychological reactions to practice.
  • Aggravation of pre-existing conditions including injuries, medical conditions, pregnancy complications, mental health conditions, and other health issues.
  • Travel-related risks for international retreats, including but not limited to illness, food-borne illness, accidents, theft, civil unrest, weather events, transportation incidents, exposure to wildlife, and exposure to local diseases.
  • Exposure to communicable diseases in shared spaces including practice halls, accommodations, and dining areas.
  • Risks associated with the activities of other participants over whom we have no control.

You acknowledge that this list is not exhaustive and that there may be other risks, both known and unknown, that arise from participation.

3. Health Disclosure and Medical Clearance

You represent and warrant that:

  • You are physically and mentally fit to participate in the program you have registered for.
  • You have disclosed to Become A Yogi any medical conditions, injuries, pregnancy, medications, or other circumstances that may affect your ability to participate safely.
  • You have consulted with a qualified healthcare professional regarding your participation, if appropriate to your situation.
  • You will inform your instructor of any condition or change in your condition that arises before or during the program.
  • You take full responsibility for monitoring your own physical and mental state during the program and for modifying or skipping any practice that exceeds your capacity or causes pain or distress.

If you are pregnant, recovering from injury or surgery, taking medication that affects balance or perception, or have any cardiovascular, respiratory, neurological, musculoskeletal, or psychiatric condition, you must disclose this to your instructor before participating, and you should consult your healthcare provider before participating.

4. Assumption of Risk

Knowing the risks described above, you voluntarily and freely choose to participate. You knowingly and willingly assume all risks, both known and unknown, of injury, illness, death, or property damage that may result from your participation, and you agree to bear the full cost and consequences of any such injury, illness, or loss.

5. Release and Waiver of Claims

To the fullest extent permitted by law, you hereby release, waive, discharge, and covenant not to sue the Released Parties from and against any and all claims, demands, actions, causes of action, suits, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your participation in any Become A Yogi program, including but not limited to claims based on negligence (other than gross negligence or willful misconduct), strict liability, breach of contract, or any other legal theory.

This release applies whether the injury, illness, or loss occurs during the program, during travel to or from the program, during free time at the venue, or at any other time related to your participation.

6. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, causes of action, suits, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) brought by you or by any third party arising out of or related to your participation in a Become A Yogi program, your conduct, or your breach of this Release.

7. Hands-On Adjustments

Become A Yogi instructors may, with your express consent, offer hands-on physical adjustments during practice. You may decline hands-on adjustments at any time, for any reason or for no reason, and your decision will be respected. If you do not wish to receive hands-on adjustments, please inform your instructor before practice begins. Your consent to hands-on adjustments is voluntary and may be withdrawn at any time.

8. Photography and Media During Programs

You acknowledge that Become A Yogi may photograph or film the program for educational, archival, and marketing purposes. A separate Photo and Media Release governs how your likeness may be used. You will have the opportunity to opt out of being photographed or filmed by notifying us before the program and by indicating your preference visually (for example, with a designated marker or wristband) during the program. We will make reasonable efforts to honor your opt-out, but we cannot guarantee that you will not appear incidentally in group photographs or wide shots.

9. Code of Conduct

You agree to participate in the program with respect, presence, and integrity. You will not engage in conduct that is harmful, harassing, discriminatory, or disruptive to other participants, instructors, or staff. Substance use that impairs your ability to participate safely is prohibited. Become A Yogi reserves the right to remove any participant from a program for conduct that violates this code, without refund.

10. Travel Insurance Recommendation

For international retreats and trainings, we strongly recommend that you purchase comprehensive travel insurance that covers trip cancellation, interruption, emergency medical care, and evacuation. This is the most reliable protection against the financial and medical risks of international travel. Become A Yogi does not provide travel or medical insurance.

11. Severability

If any provision of this Release is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Release shall otherwise remain in full force and effect.

12. Governing Law and Jurisdiction

This Release is governed by the laws of the State of [State to be confirmed by counsel], United States, without regard to conflict-of-laws principles. Any dispute arising out of or related to this Release shall be resolved exclusively in the courts of [Venue to be confirmed by counsel], and you consent to the personal jurisdiction of those courts.

13. Acknowledgment of Understanding

By signing this Release (electronically or in writing), checking the acceptance box, or otherwise indicating your agreement, you acknowledge that:

  • You have read this Release in its entirety.
  • You understand its terms.
  • You have had the opportunity to ask questions and seek independent legal advice if you wished.
  • You are signing it freely and voluntarily, without coercion.
  • You are at least 18 years of age and have the legal capacity to enter into this agreement.
  • You intend this Release to be a complete and unconditional release of liability to the greatest extent allowed by law.

You may not participate in any Become A Yogi in-person program without agreeing to this Release.

14. Contact

If you have questions about this Release before signing, please contact us at info@becomeayogi.com before the program begins.

Disclaimer for legal review: This Release of Liability and Assumption of Risk is drafted as a comprehensive starting point for Become A Yogi's in-person programs. Liability waivers in the United States are governed by state law and vary considerably in enforceability. Several states (notably Louisiana, Montana, and Virginia for certain claims) limit or prohibit the enforcement of liability waivers, and even in states where waivers are generally enforceable, they typically cannot release a party from liability for gross negligence or willful misconduct. International retreat venues may also be governed by local law. Before using this Release publicly, it must be reviewed by a licensed attorney with experience in fitness/yoga industry liability, particularly with respect to: (1) the governing law and venue selection, (2) the enforceability of the release in each state and country where Become A Yogi operates, (3) the specific language required by state-level statutes for fitness facility waivers, and (4) any additional consents required for international retreats.
